The Fall 2017 Conference was held October 8-10 at The Mirage Hotel in Las Vegas, NV. The conference started off with opening remarks from Robby Birnbaum, AFCC President, who addressed the standing room only crowd of attendees and new members and discussed recent regulatory issues facing the debt settlement industry and provided an update legislative lobbying activities being performed by the association. Attendees also heard from a number of industry leaders on topics ranging from technology, marketing, compliance and peer-to-peer and conventional loan programs.

AFCC State Legislative Updates & Compliance Review
As the leading expert on debt settlement compliance and regulation Mr. Birnbaum, the
President of the American Fair Credit Council, will provide updates on the most current, pressing issues in our industry. He will present on timely regulatory updates that every attendee needs to know to run their business in a safe and compliant manner. Attendees will review the current status of state laws, consumer protection, the approaches and what to expect from the CFPB, FTC and state regulators, and the latest licensing requirements for the industry.
Highlighting Mr. Birnbaum’s presentation will be a detailed review of the newest trends and business opportunities developing in the industry. Notably, Mr. Birnbaum will discuss the latest issues with consumer lending, including marketing to consumers through direct mail advertising and internet for loan offers, and using those offers to support term settlement payments. Mr. Birnbaum will review different and new techniques to lawfully expand business into more states, such as the latest developments with the no-advance fee Tribal Models, and what to watch out for with the ever-present use of debt settlement attorneys who purport to represent consumers. There will be substantial explanation on lawful approaches to this and how to carefully monitor and enter additional states.
Mr. Birnbaum will review the latest tactics being used to break through to collectors, especially from more troubling states like North Carolina, and being protective and safe from bankruptcy attorneys and their state Bar associations that have been posing challenges to effective negotiations. He will also review current ADA issues, and making sure your company’s website does not put you at risk for accessibility claims from consumers who need extra assistance in accessing your services.
You will receive timely updates that will be immediately useful and applicable to your company, including a fresh and direct focus on avoiding call center marketing claims, and updates on the latest techniques being used with difficult creditors. Mr. Birnbaum will also review newer contact solutions, such as those used to more quickly obtain customer approval on settlements, the use of pre-authorizations for settlements, and optional monthly programs
such as creditor defense and supporting services. -
